What is SB533 and why does it matter? 

California Senate Bill 553, signed into law in October of 2023 requires all businesses (unless exempt) to have a WVPP plan in place by July 1st, 2024. Legislation requires workplaces to safeguard employees and provide a safe and healthful workplace. Requirements include a plan, hazard assessment, training and corrections, specific reporting PII and HIPPA confidentiality requirements, and organization communication. The goal of this legislation is to keep people safe.

Organizational and workplace conflict and violence are a significant concern in California and nationally. Conflict impacts productivity and violent incidents cause significant harm to people, organizations, and culture. US workplaces suffer about 1.2 million violent incidents per year including 20,000 assaults, 400 murders and a median of 12 workdays missed per incident. Workplace violence is a known hazard, and employers have a legal and ethical responsibility to provide a workplace free of violence. 

Is my business or employer compliant? 

If you do not have a compliant plan, policy, and procedure implemented specifically for SB553, you are NOT compliant.

If you aren’t sure if your employer is compliant, ask for a copy of their SB553 / WVPP plan, they have to provide it within 15 days of your request.

What if I’m not compliant? 

We don’t believe risk acceptance or lack of compliance is an option, and ignorance is not a defense. California and Cal/OSHA’s goal is to protect workers, and we know that most employers want to do the right thing. 

The reality is that you must be in compliance and the fines surrounding the involved Labor Codes and potential Cal/OSHA actions are significant. 

California’s Injury Illness Prevention Plan (IIPP) are the most frequented cited standards in the workplace, and the WVPP is now required. In 2022, Cal/OSHA received 11,817 complaints with 13,784 citations totaling nearly $38 Million in fines. WVPP citations fall under the 334(c) and 336(c) Civil Penalty structures. Moreover, WVPP is subject to “Willful & Intentional” (334(e)) and PAGA complaints.
